Terms of sale

Terms of sale in force as of 15/09/2026 — applicable to any order placed on the empereur.fr website.

Article 1 — Seller's identity

The empereur.fr website (hereinafter “the Site”) is operated by MAISON EMPEREUR, a French limited liability company (SARL) with share capital of €42,000, registered with the Marseille Trade and Companies Register (RCS) under number 057 813 677, whose registered office is at 4 rue des Récolettes, 13001 Marseille, France — Intra-Community VAT No.: FR96 057 813 677 — Phone: +33 4 91 54 02 29 — E-mail: eshop@empereur.fr (hereinafter “the Seller”).

Article 2 — Scope and acceptance

These terms of sale (hereinafter “the Terms”) apply, without restriction or reservation, to any distance sale of products concluded on the Site between the Seller and any consumer or non-professional buyer (hereinafter “the Customer”). They prevail over any other document. The Customer declares that they have read and accepted them, by ticking the box provided for that purpose, before confirming their order. This acceptance constitutes acknowledgement that the Terms are fully enforceable. The applicable Terms are those in force on the day of the order; the Seller reserves the right to amend them at any time for future orders. Sales concluded in our shop are not governed by these Terms.

Article 3 — Products

The essential characteristics of the products (description, composition, dimensions, use) are presented on each product page. The Customer is required to read them before placing any order. Photographs and illustrations are as faithful as possible; minor variations in shade or appearance, particularly for handcrafted products or products made of natural materials (wood, cast iron, fibres), may exist without altering the essential characteristics of the product or constituting a lack of conformity. Offers are valid as long as they are visible on the Site, while stocks last.

Article 4 — Restricted products

Knives and cutting articles: the sale of cutlery items is restricted to adults. By confirming an order containing such items, the Customer certifies that they are at least 18 years old; the Seller reserves the right to request proof of age and to cancel any order that does not meet this condition.

Products subject to transport regulations: some products (flammable goods, aerosols, solvents) cannot be shipped by air or to certain destinations, in accordance with the regulations applicable to the transport of dangerous goods. The delivery options offered at checkout take these restrictions into account.

Article 5 — Prices

Prices are shown in euros, inclusive of all taxes, excluding delivery charges. Delivery charges are indicated to the Customer before final confirmation of the order. For deliveries outside the European Union, any customs duties, import taxes and handling fees remain the responsibility of the recipient (see the Shipping policy). The applicable price is the one in force on the day of the order. In the event of an obvious and gross pricing error, such that no reasonable buyer could have taken it seriously (a price derisory in relation to the actual value of the product), the Seller may cancel the order and refund the Customer in full.

Article 6 — Ordering

The ordering process comprises: selecting products and adding them to the basket; checking the contents of the basket, with the ability to correct any errors; entering delivery and billing information; a detailed summary of the order (products, prices, delivery charges); acceptance of the Terms; and final confirmation of the order, which constitutes an obligation to pay. A confirmation e-mail summarising the order is sent to the Customer. The sale is only complete once payment has been confirmed. The Seller reserves the right to refuse or cancel any order on legitimate grounds, in particular in the event of a previous dispute with the Customer, serious suspicion of fraud, or a manifestly abnormal order.

Article 7 — Payment

Payment is made in full at the time of ordering, by the means offered on the Site (bank card and other methods displayed at checkout). Transactions are secured by the Site's payment provider; the Seller has no access to the Customer's banking details. As part of fraud prevention, the Seller may request supporting documents before dispatch; the order is only dispatched once the requested documents have been received. The products remain the property of the Seller until the price has been paid in full; risk, however, passes under the conditions of Article 8.

Article 8 — Delivery

Delivery methods and destinations served are set out in the Shipping policy, which forms an integral part of these Terms. Delivery times are indicated when the delivery method is chosen. In the absence of any indication, or if the order is placed on hold, the Seller shall deliver no later than thirty (30) days after the order is concluded, in accordance with Article L.216-1 of the French Consumer Code. If the Seller fails to deliver by the agreed date or on expiry of that period, the Customer may cancel the order, after having unsuccessfully instructed the Seller to deliver within a reasonable additional period, under the conditions of Articles L.216-6 et seq. of the French Consumer Code.

All risk of loss of or damage to the products passes to the Customer at the moment when the Customer, or a third party designated by them, takes physical possession of them (Article L.216-4 of the French Consumer Code). The Customer is advised to check the condition of the parcel on receipt and to note any appropriate reservations with the carrier; the absence of reservations does not, however, deprive the Customer of any of their rights, in particular under the legal guarantees.

Article 9 — Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has fourteen (14) days from receipt of the products (or of the last product in the case of split delivery) to exercise their right of withdrawal, without having to give a reason. The Customer notifies the Seller of their decision by means of the online returns process available from their account, the model withdrawal form reproduced in the appendix hereto, or any other unambiguous statement sent to eshop@empereur.fr.

The Customer shall return the products to the Seller without undue delay and no later than fourteen (14) days after communicating their decision to withdraw, to: MAISON EMPEREUR — Retours e-shop, 3A rue de l'Académie, 13001 Marseille. The direct cost of returning the goods is borne by the Customer. Products must be returned complete (accessories, instructions, packaging). The Customer may handle the product to establish its nature, characteristics and proper functioning; they may be held liable for any loss of value resulting from handling beyond that.

The Seller shall refund the Customer all sums paid, including the original delivery charges (at the cheapest standard rate offered), within 10 working days of receiving the return. The refund is made using the same payment method as the one used for the order, unless the Customer expressly agrees to another method.

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised in particular for: goods made to the Customer's specifications or clearly personalised (engraving, made-to-order work); goods liable to deteriorate or expire rapidly; goods unsealed by the Customer after delivery that cannot be returned for reasons of hygiene or health protection (unsealed cosmetics, soaps and toiletries); goods which, after delivery, have been inseparably mixed with other items.

Article 10 — Legal guarantees

Independently of any commercial warranty, the Seller is bound by the legal guarantee of conformity (Articles L.217-3 to L.217-20 of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code).

Statutory information box (Article D.211-2 of the French Consumer Code)

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it appeared.

The legal guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:

1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place more than thirty days later;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;
4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious as to justify immediate price reduction or termination. In such cases the consumer is not required to request repair or replacement of the goods beforehand.

The consumer is not entitled to have the sale cancelled if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until delivery of the restored goods.

The rights described above result from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.

A seller who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L.241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

To invoke these guarantees, the Customer contacts customer service at eshop@empereur.fr, describing the defect observed and attaching any relevant supporting documents. The cost of returning non-conforming goods is borne by the Seller.

Article 11 — Gift cards

Gift cards sold on the Site may be used on the Site, in one or more instalments, for a period of one year. They are neither refundable nor exchangeable for cash, except where the right of withdrawal is exercised on the purchase of the card itself before any use.

Article 12 — Liability

The products offered comply with current French legislation. The Seller cannot be held liable for damage resulting from use of the products contrary to their intended purpose or the manufacturer's recommendations, or for non-performance of the contract in the event of force majeure within the meaning of Article 1218 of the French Civil Code. Nothing in these Terms shall deprive the consumer Customer of the rights they hold under mandatory legal provisions.

Article 13 — Intellectual property

All elements of the Site remain the exclusive property of the Seller or its partners. No order entails any transfer of intellectual property rights.

Article 14 — Personal data

The Customer's personal data is processed in accordance with the Site's Privacy policy, which details the purposes, legal bases, retention periods and rights of the persons concerned.

Article 15 — Mediation and dispute resolution

In the event of a complaint, the Customer should contact customer service first (eshop@empereur.fr). In accordance with Articles L.612-1 et seq. of the French Consumer Code, failing amicable resolution, the consumer Customer may have free recourse to a consumer mediator. The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Article 16 — Governing law

These Terms and the sales they govern are subject to French law. Any dispute shall be brought before the competent French courts, in compliance with the jurisdiction rules protecting consumers, who may in particular bring proceedings before the courts of the place where they resided when the contract was concluded.

Article 17 — Miscellaneous

If any provision of these Terms is declared void or deemed unwritten, the remaining provisions shall remain fully applicable. The Seller's failure to rely on any provision of these Terms at any given time shall not constitute a waiver of the right to rely on it at a later date.
