ARTICLE 3 - PRICE

The applicable price is the one indicated on the site at the date of registration of the order by the customer.
Any delivery costs are indicated to the customer at the end of the order and before the final validation of it in addition to the price of selected products.
ARTICLE 4 - ORDERED
4.1. The customer account
4.1.1. When ordering, the customer agrees to provide information requested such as names, first names, mailing address and email, phone.
4.1.2. The information provided by the Customer being essential for the processing of his order, the routing of his order and the establishment of invoices, the absence of this information will result in the cancellation of the order sent by the Customer to MAISON EMPEREUR.

4.3. Confirmation of the order by MAISON EMPEREUR
4.3.1. Any order sent by the Customer to MAISON EMPEREUR will be the subject of a confirmation sent to the Customer by email to the address indicated by the Customer within a maximum of 48 hours from receipt of the orde. The order confirmation will be considered valid even if the email address provided by the Customer is incorrect.
4.3.2. In the absence of confirmation by MAISON EMPEREUR, the Customer's order will be considered as not received by MAISON EMPEREUR.
4.3.3. Only the actual payment of the order by the Customer and the acceptance of these general conditions of sale will result in the final validation of the order.
4.3.4. MAISON EMPEREUR reserves the right to refuse any order sent by a Customer for whom there is an order or payment in dispute until the situation is rectified.
ARTICLE 5 - AVAILABILITY OF PRODUCTS
In the event of out of stock between the time of the order and the time it is received by MAISON EMPEREUR, MAISON EMPEREUR undertakes to inform the Customer within 48 hours and to propose to him:
- the cancellation and refunding of the order.
- the shipment of a similar product of quality and equivalent price.
ARTICLE 6 - SECURE PAYMENT OF ORDERS
6.1. MAISON EMPEREUR provides the Customer with the following payment method:
Payment by credit card: MAISON EMPEREUR or any intermediary trusted third party such as PayPal or any banking institution acting in his name and on his behalf will debit the customer's credit card of the total price of the order (including shipping costs). In the absence of authorization to debit the Customer's credit card, the Customer's order may not be accepted by MAISON EMPEREUR.

ARTICLE 7 - SHIPPING AND DELIVERY TIMES
7.1. Place of delivery
The products ordered by the Customer on the site www.empereur.fr can be delivered in Metropolitan France, including Corsica, and abroad.
7.2. Delivery date
The estimated delivery date is detemined according to the following 3 elements:
- The deadline for the validation of the order (24 to 48 hours maximum) correspnding to the delays of confirmation of the payment of the order and the possible verification of the personal data of the Customer
- The shipping time of the order (see below 7.3).
- The delivery time which depends on the delivery method and the country in which the delivery is to be made.
7.3. Delivery time for products in stock
7.3.1. When the Customer's order is transmitted and confirmed by MAISON EMPEREUR before 12 noon - Paris time - Monday to Friday, excluding holidays, the shipping of the order will be made by MAISON EMPEREUR the next day, or th Monday of the following week. For orders made on Fridays.
7.3.2. Any order sent by the Customer and validated by MAISON EMPEREUR after 12:00 pm Paris time - Monday to Friday, excuding public holidays will be dispatched two days later, or the Tuesday of the following week for orders arrived on Friday.
7.3.3. Any order sent to MAISON EMPEREUR during the weekend will be confirmed on Monday and, subject to payment by the Customer, shipped on Tuesday.
7.3.4. The deadline for delivery of the order will be communicated to the Customer upon confirmation of the order sent by MAISON EMPEREUR to the email address provided by the Customer.
7.3.5. In the event of a delivery delay of more than 7 (seven) days, with regard to the delivery deadline announced by MAISON EMPEREUR, the Customer may cancel the order concerned by registered letter with acknowledgment of receipt.
7.3.6. In this case, MAISON EMPEREUR undertakes to reimburse the Customer the sums paid within 30 (thirty) days from the date of payment of the order.
ARTICLE 8 - TERMS OF DELIVERY
8.1. No order will be sent by MAISON EMPEREUR in the absence of payment of the full price except pomotional or marketing operations by arranging differently.
8.2. The order will be deliverde to the address indicated by the Customer during the validation of the order. MAISON EMPEREUR ensures its deliveries only on working days and at working hours.
8.3. In case oh absence of the Customer or the recipient of the parcel in case of delivery to a different address, the carrier will leave a notice of passage allowing the withdrawal of the parcel.
8.4. MAISON EMPEREUR therefore can not be held reponsible for delays, defects or delivery problems that my result from the provision of incorrect information by the Customer. Only the Carrier can judge the accessibility of the premises.
8.5. MAISON EMPEREUR will provide Customer with all necessary information to enable them to track the shipment and delivery of the order.
8.6. In case of non receipt of a package wuthin the time indicated, and once informed by the Client, MAISON EMPEREUR will open an inquiry with his carrier.
8.7. The Customer will then receive an email indicating that an investigation is open. The final response time of the carrier is generally 14 to 21 working days.
8.8. If the package is found, it is then sent to the Customer. The delivery procedure described aboce will follow its normal course.
8.9. If the parcel is declared lost, MAISON EMPEREUR will then notify the Customer and proceed with the formalities for reimbursement of the order corresponding to the lost package (products and shipping costs).
8.10. A delay in delivery can not give rise to any compensation or a refund.
ARTICLE 9 - CONFORMITY OF PRODUCTS
9.1. Upon receipt of the order, the Customer must verify the conformity of the products delivered with the order sent to MAISON EMPEREUR and the good condition of the delivered products. The customer (or his representative) must unpack the product in the presence of the carrier before signing the delivery note. If the product has a defect the customer must indicate its reserves (damaged product, or non-compliant...) on the delivery, accompanied by its signature and that of the deliveryman and inform the company MAISON EMPEREUR by mail.
In the event of a package likely to have been opened or in the presence of obvious signs of deterioration, it is up to the Customer to make all reservations and clainms that would appear justified, or even refuse the package. The said reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within 3 working days after delivery of the products, a copy will be sent immediately to MAISON EMPEREUR.
9.2. In the case where such statements have not been made on the delivery bill presented to the Customer by the carrier or in the absence of the written claim with the carrier within the aforementioned period, no claim relating to the parcels could not be accepted a posteriori by MAISON EMPEREUR.
ARTICLE 10 – RIGHT TO RETRACT
In accordance with the provisions of articles L. 121-21 et following of the Consumer Code, you have a period of fourteen calendar days from receipt of the last product of your order exercise your right of withdrawal without having to justify reasons or pay penaltlies, with the exception of the remain your responibility.

11.2. Where to return the product ?
The goods must be sent packaged and insured to the carrier for the market value of the product. These precautions are necessary in case of deterioration or loss of the goods by the carrier.
Small items can be returned to us by mail.

• The legal guarantee of conformity.

The action resulting from the latent defects must be brought by the purchaser within two years from the discovery of the defect.
CODE OF CONSUMPTION

12.1. In the event of a defect preventing normal use of the product deliverd by MAISON EMPEREUR, the customer may return the defective item accompanied by a copy of the invoice, the warranty certificate and the return number obtained in accordance with the procedure detailed in Article 11.1
12.2. The Customer may ask MAISON EMPEREUR, to choose :
- The delivery of a product identical to that ordered, within the limits of available stocks;
- The delivery of a product of quality and equivalent price, within the limits of available stocks;
- The refund of the price of the product on the date of the order within 30 (thirty) days following its request.
ARTICLE 13 - DISPUTE AND LIABILITY
13.1. MAISON EMPEREUR can not be responsible for the breach of the contract concluded:
• In case of force majeure, blocking of telecommunications networks, strikes, national or local state of emergency, bad weather, etc...
• In case of fault of the customer,
• The unpredictable fact of a third party to the contract.

15.1. The name MAISON EMPEREUR was registered by MAISON EMPEREUR as a Community trademark.
15.2. The MAISON EMPEREUR community trademark and the domain name empereur.fr, its regional or thematic derivatives, constitute protected names belonging to MAISON EMPEREUR.
15.3. Any use of the terms associated MAISON EMPEREUR is prohibited without the prior written permission of MAISON EMPEREUR.
15.4. The site and its contents are protected, within the meaning of the code of the intellectual property, in particular by the rights of author and marks.
15.5. The elements published on the site www.empereur.fr including logos, texts, photographs, images or drawings constitute works protected by intellectual property rights or human rights.
